Appendix A NOTICE OF VIOLATION Harry S. Truman Memorial

-License No. 24-15235-03 Veterans Hospital As a result of the inapection conducted on July 16, 1981, and in accordance with the Interim Enforcement Po! icy, 45 FR 66754 (October 7,1980), the following violations were identified:

1.

License Condition No. 21 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in application received October 11,.1977, and letter with enclosures dated May 18, 1978, and letter dated February 8,1979.

The letter dated May 18, 1978, states that survey instruments shall be calibrated annually.

Contrary to this requirement, the last calibration of the Victoreen 491, PMI 6665-5051 was May 28, 1930.

This is a Severity Level V violation (Supplement VII).

License Condition No. 21 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in application received October 11, 1977, and letter with enclosures dated May 18, 1978, and letter dated February 8, 1979.

The letter dated May 18, 1978, states that the procedures described in Appendix D, Section 2 of the NRC Guide NUREG-0338, Revision 1, dated November 1,1977, shall be followed for calibration of the dose calibrator. Appendix 0, Section 2 states that quarterly linearity, annual accuracy, and a geometrical variation check of the dose cali-brator shall be performed and recorded.

Coutcsry to this requirement, the last linearity check of the dose calibrator. was performed on June 18, 1980. An annual accuracy check of the dose calibrator has-not been performed since the date of license issuance. ' Graphs of the geometrical variation check of the dose calibrator sere not kept.

This is a Severity Level V violation (Supplement VII).

Appendix A The letter dated May 18,I1978, states that the procedures described in Appendix I of NRC Guide NUREG-0338, Revision 1, dated November 1,1977, will.be followed for performing area contamination surveys. - Appendix I states that. daily G-M surveys of all elution and injection areas, shall'-

be performed and recorded. Laboratorica where quantities greater than 100 microcuries are used will be surveyed with a G-M survey meter and

.i wipe tested weekly.

Contrary to these requirements,' daily LG-M surveys of all' elution and injection areas were not performed from September-3, 1980, to July 15, 1981. Laboratories where quantities g'reater than 100 microcuries were used were not wipe tested weekly. Specifically, wipe tests of the-Nuclear Medicine Hot Laboratory were performed monthly rather than' weekly.

This is a-Sevetity Level V violation (Supplement VII).

License Condition No. 21 requires that licensed material be post.essed and used in accordance with statements, cepresentations, and procedures contained in application received October 11, 1977, and letter with-enclosures dated May.18, 1978, and letter dated February 8,1979.

The letter dated May 18, 1978, states that records of the survey results of the exhaust from the xenon-133 trap shall be kept.

Contrary to this requirement, records of the survey results'of'the exhaust from the xenon-133 trap were-not kept since'the date of-license-issuance.

This is a Severity Level VI violation (Supplement VII).

10 CFR 20.401(b) requires that you maintain records showing the results, of surveys that you made to assure compliance with 10 CFR 20.201(b)

" Surveys."

Contrary to the above, you failed to maintain records of results of.

such surveys as were necessary to assure compliance with.10-CFR 20.301, a regulation that describes' authorized'means'of disposing of licensed material contained in waste. Specifically, the Nuclear Medicine Department failed to maintain records of surveys' of radioactive waste to assure that no measurable radiation above background was present prior to disposal as normal-_ trash from October 12, 1979, to the day-of_this inspection.

This is a' Severity Level VI. violation (Supplement IV).

Pursuant to the provisions of 10 CFR-2.201,.you are regnired to submit 1to this office within thirty days of the date of'this Notice a written statement.

Appendix A 3-or explanation in reply, including for each item of noncompliance:

(1) cor-rective action taken and the'results achieved; (2) corrective action to be taken to avoid further noncompliance;'and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this_ response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
