Appendix A NOTICE OF VIOLATION Cincinnati Gas and Electric Company Docket No. 50-358 As a result of the inspection conducted on June 1-5, 8-12, 15-19, and 22-26, 1981, and in accordance with the Interim Enforcement Policy,-45 FR 66754 (October 7, 1980), the following violation was identified:

10 CFR 50,- Appendix B, Criterion XVI, requires in part: " Measures shall be established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment,-

and nonconformances are promptly identified and corrected."

Wm. H. Zimmer Nuclear Power Station Quality Assurance Manual, Section 16.1 states in part:

"The 'A Division of CG6E is responsible for evaluating QA program deficiencies luentified by project participants. Audits shall be reviewed to assist in identifying QA nonconformances. The corrective action required to eliminate the deficiencies, assurance that corrective action is taken and appropriately documented, and reporting such deficiencies and corrective actions to appropriate levels of management, it is the responsi-bility of QA."

Contrary to the above, CG&E QA Division failed to take action to identify and correct procedural nonconformances related to system turnover for preoperational testing and the System Index Test Matrix which were repeatedly identified by NRC inspectors over a period of three months.

In addition, two QA audits performed as a result of unresolved item 50-358/

81-07-01 failed to identify specific deficiencies in the inclusion of con-struction test documentation in turnover package PT-VC-02, even after the specific deficiencies listed in paragraph 6.b(1) of IE Inspection Report No. 50-358/81-18 were identified to licensee personnel.

This is a Severity Level IV Violation (Supplement II).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance; (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
