ORDER RELATIVE TO CBG MOTION

FOR RECONSIDERATION OF THE BOARD'S ORDER OF JULY 1, 1981 The Board's order of July 1,1981, granted the UCLA motion for a protective order for Interrogatories Nos. 53-61 under Contention VI -

(radiationprotection). CBG now moves on July 10, 1981, for reconsidera-tion of interrogatories Nos. 55a, b, c, 57e, 59 and 60. CBG asserts that these interrogatories have a clear relevance to issues of radiation pro-tection and monitoring put at issue by Contention VI.

It also was stated-l l

that these interrogatories meet the " general relevancy" test.

On July 27, 1981, UCLA reiterated its argument that these interroga-tories were not relevant since they pertain to a contention the Board rejected in its March 20, 1981, order (shipment of fuel).

The CBG motion. mentioned the UCLA had responded to two interrogatories relative to Cobalt-60 at NEL.

d i Nos. 51 and 52.) We also note that the CBG response interrogatories (SetThree)submittedonJune 10, 1981, are replete with interrogatories relative to Cobalt-60.

The Board's order of March 20, 1981, did not allow Contention XXIV relative to the shipment of fuel for the reason stated. We granted the Protective Order for Contention VI Interrogatories.Nos. 53-61 since they pertained to shipment of fuel. We have determined that the CBG motion of July 10, 1981, is an attempt to reopen the shipment contention and falls within that rejected contention rather than Contention VI.

The motion for reconsideration is denied.

IT IS SO ORDERED.
