Dear Mr. Knapik:
This is in reply to your letter dated May 22, 1981, in which you requested pursuant to the Freedom of Information Act, a copy of two documents identified as SECY-81-233, Prospective changes to U.S. Non-Proliferation Policy, and a letter from the NRC to the Department of State that follows up on the SECY paper.
In response to your request, we are herewith providing you with copies of the documents listed on Appendix A with the exempt portions deleted.
Document one of Appendix A contains information classified pursuant to Executive Order 12065. This information is being withheld from public t
disclosuie pursuant to Exemption (1) of the Freedom of Information Act (5 U.S.C. 552(b)(1)) and 10 CFR 9.5(a)(1) of the Commission's regulations.
Documents one and two of Appendix A contain information which constitutes advice, opinions, and recommendations of the staff.
This information is being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C. SS2(b)(5)) and 10 CFR 9.5(a)(5).
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
The person responsible for this denial is Mr. Samuel J.
Chilk, Secretary of the Commission.
l This denial may be appealed to the Commission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
