APPENDIX A NOTICE OF VIOLATION Veterans Administration hcspital License No. 46-00990-01 4435 Beacon Avenue South Seattle ~, Washington 98108 As a result of the Washington state inspection on June 2,1981, and in accordar.ce with the NRC Interim Enforcement Policy, 45 FR 66754 (October 7,1580), the following violations were identified:

A.

49 CFR 173.392(c)(1) states that materials must be packaged in strong, tight packages so that there will be no leakage of radioactive material under conditions normally incident to transportation.

Contrary to this requirement, drum number 5, identified on RSR, ilo.

09019, dated June 1, 1981, (see Attachment A) was leaking liquid when received at the burial site.

Loosa radioactive contamination detected by a wipe of the drum ranged from 150-200 cpm (beta-gamma) above background.

This is a Severity Level IV Violation (Supplement V).

B.

49 CFR 173.392(c)(8) states that the outside package must be stencilled or otherwise marked " Radioactive-LSA".

Contrary to this requirement, drum number 3, identified on RSR, No.

09019, dated June 1,1981, (see Attachment A) was not marked as " Radioactive-LSA".

This is a Severity Level IV Violation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, the Veterans Administration Hospital, Seattle, Washington is hereby required to submit to this office within thirty days of the date of this notice, in written statement or explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further items of noncom, liance; and (3) the date when full compliance will be achieved. Consideration nay be given to extendina your response time for good cause shown.

The responses directed by this Notice are not. subject to the clearance procedures of the Office of Managenent and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
