In your letter, you requested infon'ation as to whether or not the Price-Anderson Act covered nuclear accidents that occurred as a result of an carthquake. As is explained below, the simple answer to your question is "yes".
Licensees of large nuclear power plants are required by section 170 of the Atenic Energy Act of 1954, as anended, (42 U.S.C. 2210) to have and naintain insurance and governnent indeenity in the anount of $560,000,000.
In the event of a nuclear incident, this noney would be used to satisfy public liability clains except (i) clains under State or Federal worknen's cccpensation acts, (ii) clains arising out of an act of war, and (iii) claims of loss of, or danage to, or loss of use of the licensee's onsite property.
(42 U.S.C. 2014(u)).
Briefly, the tem " nuclear incident" neans any occurrence (e.g., an carthquake) within the United States causing " bodily injury, sickness, disease, or death, or loss of or danage to property, or loss of use of property, arising out of or resulting from the radioactive, toxic, explosive, or hazardous properties" of the radioactive naterial at the nuclear power plant site. Thus, the offsite personal injury and property danage resulting fron radioactive material released due to an earthquake would be covered by the Price-Anderson Act.
