W Appendix A NOTICE OF VIOLATION Mineral Area Osteopathic Hospital License No. 24-18040-01 Based on the inspection conducted on July 16, 1981, it appears that certair of your activities were in noncompliance with NRC requirements, as noted below.

Items 1 and 2 are infractions, and Item 3 is a deficiency.

1.

10 CFR 20.101(a) limits the whole body exposure of an individual in a restricted area to 1.25 rems per calendar quarter, except as provided by 10 CFR 20.101(b). Paragraph (b) allows a whole body exposure of 3.0 rems per calendar quarter provided certain specified conditions are met.

Contrary to this requirement, an individual working in your restricted area received a whole body radiation dose of 1.60 rems during the fourth calendar quarter of 1979, and 3.04 rems during the first calendar quarter of 1980.

In both cases the conditions of Paragraph (b) were not met.

10 CFR 20.405(a) requires that you submit within 30 days, a report to the Commission concerning each exposure to radiation in excess of any applicable limit in Part 20 or in your license.

10 CFR 19.13(a' requires that this report be submitted to the individual exposed.

Contrary to these requirements, as of July 16, 1981, you failed to report to the Commission, and to the individual exposed, the exposures described in Item I above.

License Condition No. 14 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in application dated December 17, 1979.

Item 10 of the application states the procedures described in Appendix D, Section 2, of the NRC Medical Licensing Guide will be used for calibration of the dose calibrator. Appendix D, Section 2, requires a geometrical variation (at installation), annual accuracy, quarterly linearity, and daily constancy checks of the dose calibrator.

Appendix A Contrary to the above requirements, full compliance with Appendix E, Section 2, was not met.

Specifically, completed records were not available for the linearity tests for the first and second calendar quarters of 1981.
