S Appendix A NOTICE OF VIOLATION Paris Community Hospital License No. 12-14142-01 As a result of the inspection conducted on June 22, 1981, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980),

the following violations were identified:

1.

License Condition 14 requires that licensed material be possessed and used in accordance with statements, representations, and pro-cedures contained in application dated September 3, 1976, and letters dated November 16, 1976, January 27, 1977, and August 12, 1977.

License application dated September 3, 1976, states that licensed material shall be used by or under the supervision of the physician named in the license.

Contrary to this requirement, from May 1980 to June 1981, an indi-4 vidual not authorized by your license used licensed material in your Nuclear Medicine Department.

This is a Severity Level V violation (Supplement VII).

letters dated November 16, 1976, January 27, 1977, and August 12, 1977.

License application dated September 3, 1976, names Thomas W. Hogan, M.D. as the radiation protection officer.

Contrary to this requirement, from May 1980 to June 1981, the indi-vidual designated as your radiation safety officer was changed and you failed to amend your license to reflect this change.

This is a Severity Level V violation (Supplement VII).

Appendix A 3.

License Condition 14 requires that licensed material be possessed and used in accordance with statements, representations, and pro-cedures contained in application dated September 3, 1976, and letters dated November 16, 1976, January 27, 1977, and August 12, 1977.

The letter dated January 27, 1977, states that the dose calibrator will be checked daily for constancy and annually for accuracy.

Contrary to these requirements, the dose calibrator was not checked for constancy on 19 occasions between March 20, 1981, and May 15, 1981.

An accuracy check of the dose calibrator has not been performed since the date of license issuance.

This is a Severity Level V violation (Supplement VII).

License Condition 14 requires that licensed material be possessed and used in accordance with statements, representations, and pro-cedures contained in application dated September 3, 1976, and letters dated November 16, 1976, January 27, 1977, and August 12, 1977.

The letter dated January 27, 1977, states that the Radiation Safety Committee shall meet quarterly.

Contrary to this requirement, no Radiation Safety Committee meeting was held between September 4, 1980 and the date of this inspection.

This is a Severity Level V violation (Supplement VII).

5.

License Condition 14 requires that licensed material be possessed and used in accordance with statements, representation., and pro-cedures contained in application dated September 3, 1976, and letters dated November 16, 1976, January 27, 1977, and August 12, 1977.

License application dated September 3, 1976, states that surveys shall include isotope storage areas.

Contrary to this requirement, the molybdenum - technetium generator storage area has not been surveyed since the date of license issuance.

This is a Severity Level V violation (Supplement VII).

Part 35.14(e)(1)(i) requires that sealed calibration or reference sources shall be tested for leakage and/or contamination at intervals not to exceed six months.

Part 35.14(f)(2) requires that the sealed calibration or reference sources be physically inventoried each quarter to account for all the sources received and possessed.

Appendix A Contrary to these requirements, your nominal 216 microcurie cesium-137 sealed source serial number 319-015-09 has not been leak tested since the date of license issuance. Quarterly inventories of your scaled sources have not been performed since the date of license issuance.

This is a Severity Level V violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance-(1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved.

Under the authority of Section 182 cf the Atomic Energy Act of 1954, as amended, this response shall be submitted unuer oath or affirmation.

Consideration may be given to extending your response time for good cause shown.
