MITHHOLDIllG FROM PUBLIC DISCLOSURE REPOP.T NO. CBO-N-79-064 (HADDAM NECK AND MILLSTONE 1)

By letter dated April 5,1979, you submitted Carborundun Coiapany Test Progran Report No. CEO-t!-79-064, which supplements the information contained in C50-N-78-299, transmitted to the NPC by your letter dated November 3,1978.

You requested that this report be withheld from public disclosure pursuant to 10 CFR 2.790(b). The withholdin9 request is supported by an affidavit noto-rized April 2,1979, by Mr. Rouert G. !!aum, Manager Nuclear Business Unit, The Carboruncua _ Company. A nonproprietary version of the subject report was also transnitted.

The report contains documentation of the fourth test for the B C'requalifica-4 tion program pertaining to the spent fuel racks at the haadam Heck Plant and Hillstone Station Unit 1.

Carborundum states in its affidavit that the information sought to be withheld is the results of their using one or more proprietary manufacturing techniques, descriptions of improvements in boron carbide containing articles and the descrip-tions of the effects of testing such boron carbide containing articles, which is owned and have been sold in confidence by Carbarundum. The affidavit also contends that the information consists of data pertaining to the manufacture, conposition, testing, use and sale of baron carbide containing nuclear shielding systems, the application of which provides a co petitive econo.ic advantage for Carborundua.

Moreover, the avfidavit indicated that the infornation is not available in public sources, and that the release of such information would cause Carborundum competi-tive harm.

He have reviewed the subject report band on the requirements and criteria of 10 CFR 2.790 and have determined that CBO-N-79-064 contains proprietary conercial information.

We also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not cutucigh the demon-strated concern for orotection of Carborunduo's cc*petitive position. Accordingly, we have determined that the applicaole information should be withheld from public G nlm. v.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the docurent.

If the basis for withholding this information from public inspection should change in the future such that the infomation could then be made available for public inspection, you or The Carborundun Conpany should promptly notify the NRC.
