Dear Mr. Grier:
By letter dated April 24, 1981, you provided us with a copy of a letter, dated April 6, 1981, that FEMA sent to the New York State Disaster Preparedness Commission.
The April 6, 1981, letter contains a list of asserted deficiencies in the New York Radiological Emergency Preparedness Plan and the emergency response plans for the Counties that are within the ten (10) mile emergency planning zones of the Indian Point 3 and James A.
FitzPatrick Nuclear Power Plants.
l The attachment to this letter describes plans for correcting l
each of the asserted deficiencies identified by FEMA.
The reso-lutions of the deficiencies described in the attachment were coordinated with Consolidated Edison, Niagara Mohawk, and State l
and County emergency planning groups.

- Comment :
The relationships between the State and the Counties have yet to be resolved.
C Resolution:
A generic clarification of emergency planning allocation of responsibilities among different levels of g-government is desirable in New York State, and the affected utilities are proposing legislation which should assist the coordination of emergency planning activities in the State.
At present, Article 2-B of the New York State Executive Law specifies the emergency planning relationships between the State and Counties.
This law and l
l in particular sections 21 (3)(f), 22, 23, and 24 thereof, supplies an adequate basis at present for establishing the necessary governmental relationships.
The County Plans are written in accordance with the State law as it exists today, and we believe that the applicable NRC criterion as stated in the regulation 4.s specifically and adequately addrecsed in the County plans as they presently exist.
Greater specificity with respect to assignment of support roles to State Agencies is required in the plans and this problem will be corrected with the promised cooperation of the New York State Nuclear Emergency Planning Group.
