By applications dated July ll,1978 and June 20,1980, your company requested deletion of certain Environmental Technical Specifications for the Cooper Nuclear. Station (Facility L1 wse No. DPR-46). With these applications, which were filed with-the Office of Nuclear Reactor Regulation (ONRR),' fees totalling

It has now been detemined that fees should not be charged for the deletion of:
i non-radiological aquatic LCO's.and other non-radiological monitoring' requirements in cases where licensees have an effective NPDES Permit. On this basis, we have concluded that an exemption, pursuant to 10 CFR 170.ll(b). from the fee require-ments is authorized by law and such exemption.is otherwise in the public ' interest and-is hereby granted.for the July 11,1978 and June ~20, 1980 applications.
Therefore, we have concurrently authorized the Office of the Controller to refund t
to you the remaining $5,200 paid for these applications. Refunds are generally processed by the Office of the Controller within a two-week period.
