Dear Mr. Flack:

On September 25, 1980, you requested on behalf of Georgians Against P uclear Eneroy (GAHE) that the Nuclear Regulatory Comission reconsider it'. decision to issue construction pemits to Georgia Power Corrany for the construction of the two Vogtle nuclear facilities. As a basn, of its request, GAME cited an electricity demand forecast subritted by GPC to the Georgia Public Service Comission. According to GAHE, this forecast indicates that upon cor'pletion of the tuo Vogtle facilities, GPC will have greater excess reserve generating capacity than was origina'llyanticipated in the initial construction remit proceedi ng.

GANE asserts that this inforration regarding excess capacity constitutes new infomation not previously considered by the NRC.

GANE's petition has beer treated under 10 CFR S 2.206 of the Comisrion's regulations. Upon revim of GANE's filings and of other relevant infomation, I have deterr. lined to deoy the request. The reasons for this decision are fully discussed in the enclosed " Director's Decision under 10 CFR 52.206."

Also ec-losed is a copy of a Federal Register Notice renardinn this decisinn that ~. 5 being filed with the Office of the Federal Register.

A copy of this decision will be placed in the Comission's Public Deccent

On September 25, 1980, you requested on behalf,0f Georgians Against Nuclear Energy (GANE) that the Director of Huelear Reactor Regulation hold hearings to assess the need for power from the Alvin W. Vogtle Nuclear Plant, Units 1 & 2.

As a basis of its request, GANE cited an electricity demand forecast submitted by GPC to the Georgia Public Service Comission. According to GANE, this forecast indicates that upon completion of the two Vogtle facilities, GPC will have greater excess reserve generating capacity than was orginally anticipated in the initial construction permit proceeding. GANE asserts that this information regarding excess ca'pacity constitutes new information not

previously considered by the NRC..-p GANE's position has been treated undet 10 CFR 5 2.206 of the Cocnission's regulations. Upon review of GANE's filings and of other relevant information, I have determined to cany the request.

The reasons for this decision are fully discussed in th( enclosed " Director's Decision under 10 CFR S2.206."
