MOTION TO TERMINATE THIS PROCEEDINC on October 12, 1979, the New York State Board on Electric Generation Siting and the Environment (Siting Board) issued an order dismissing Caso 80008 in which New York State Electric & Gas Corporation and Long Island Lighting Company (Applicants) sought a Certificate of Environmental Compatibility and Public Need for the New Haven Units as required under Public Service Law Article VIII.

As a result of this decision, on October 29, 1979, Applicants filed a " MOTION FOR INDEFINITE DELAY IN THIS PROCEEDING DUE TO THE DISMISSAL BY THE STATE SITING BOARD OF CASE 80008",

On November 12, 1979, the Applicants moved for a rehearing of the order issued in Case 80008 dismissing the e,

proceeding.

By order issued May 23, 1980, the-Siting Board denied the motion for rehearing.

Applicants have abandoned their attempts to license a nuclear-fueled generation station at the New Haven or Stuyvesant sites and have as of October 16, 1960, withdrawn their application to the Nuclear Regulatory Commission, dated November 9, 1978, for construction permits for New Haven Units 1 and 2 (Exhibit A).

Therefore, Applicants move to terminate this proceeding before the Atomic Safety and Licensing Board.
