Docket Nos. 50-250-OLA-5 and 50-251-OLA-5 (Technical Specifications Replacement)
Dear Licensing Board Members
- In a Memorandum and Order dated February 13, 1990, the l
Licensing Board ruled on a motion for extension of time filed by-Thomas J. Saporito, Jr. and the Nuclear Energy Accountability i
[
Project (collectively referred to as "Petitionars").
Although 7
the-Board found that Petitioners had not demonstrated good cause for-an extension, the Board adopted Applicant's suggestion (with concurrence from the NRC Staff) that Petitioners be granted an extension of time until March 1, 1990, to file their amended
, petition to intervene.
Following the grant of the extension, Petitioners communicated with the Applicant and the NRC Staff to determine 9003050037 900220 PDR ADOCK 05000250 9l O

The purpose of this letter is to state the position of the Applicant regarding this latest request for an extension of time.
.The Petitioners have not identified any good cause for another extension and have not indicated that there would be something to be gained from a further delay.
Nevertheless, the Applicant would be amenable to another extension, provided that the extension does not impact the schedule for the limited appearance session and prehearing conference, which are set for March 22 and March 23, 1990, respectively.
The NRC Staff has authorized us to advise the Board that it agrees.
Accordingly,
/~N the Applicant and the NRC Staff would not object if the schedule
',,)
for this proceeding were modified as follows:
s Date Event March 5, 1990 Petitioners Pile Amended Petition 2/
March 19, 1990 Applicant and NRC Starf File Responses 2/
March 22, 1990 Limited Appearance Session i
March 23, 1990 Prehearing Conference Respectfully
- bmitted,
