This refers to- the special inspection conducted by Mr. Richard A. Plasse of
'this office on ' January 31 ' through February 7,1990.
Messrs. R. Plasse and

W. Schmidt presented ~the findings to you and members of your staff at the
conclusion of the. inspection.

Mr. Plasse conducted this inspection to review the circumstances leading to
- !
.
your January 29, 1990 determination that core thermal power was .7% above your
l
r
licensed ' thermal power.
This report documents an apparent violation of your
. licensed' thermal power limit. Further, several instances were identified where
'
NYPA failed to take adequate and timely actions to prevent the violation of the
unit's licensed power. Information which reasonably questioned the calibration
of your feed flow instruments was brought to your attention in 1988 by .an
October 12 operational event report and a November.18 GE Service Information
Letter Supplement.
This information apparently did not receive appropriate
review. Also, when this information was reviewed again by you between November
1989 and January .1990, you did not take conservative action' to reduce plant
, .
power to prevent exceeding your thermal power, while evaluating the conditions.
Based. on these concerns we plan to schedule an enforcement' conference in the
Region.I office to discuss the root causes of your exceeding the licensed ther-
mal power. Further, you should be prepared to discuss the safety significance
of the apparent violations, the corrective actions taken and any aggravating or
,
mitigating factors regarding these items.
We will contact you to arrange a

mutually' agreeable date for the-enforcement conference,
