STRETCH GOAL FOR THE 10 CFR 52.103(G) FINDING ON VOGTLE UNITS 3 AND 4
Dear Mr. Yox:
The U.S. Nuclear Regulatory Commission (NRC) staff recently held two Category 1 public meetings with Southern Nuclear Operating Company (SNC) at NRC Headquarters to identify ways to safely reduce the time required by the NRC for making the Title 10 of the Code of Federal Regulations (10 CFR) Section 52.103(g) finding following receipt of an all inspection, test, analysis, and acceptance criteria (ITAAC) complete notification (required by 10 CFR 52.99(c)(4)) for the Vogtle Electric Generating Plant Units 3 and 4.
On August 13, 2019, the NRC staff presented a best-case stretch goal processing timeline which assumed all prerequisites were met (as shown on the NRC meeting slides in the Agencywide Documents Access and Management System (ADAMS) under Accession Number ML19224A924). The staff discussed the prerequisites and compared the stretch goal timeline against the timeline shown in NRR-LIC-114 / NRO Office Instruction NRO-REG-106, Title 10 of the Code of Federal Regulations (10 CFR) Section 52.103(g) Finding and Communication Process, (ADAMS Accession Number ML18267A001), that projects a 17-day timeline to complete the process. On September 10, 2019, the NRC staff presented draft notifications to be submitted on the 10 CFR 52.103(g) finding process for SNC's Vogtle Electric Generating Plant Units 3 and 4, as well as different scenarios that could affect the expected time to process the 10 CFR 52.103(g) finding. The meeting summary can be found at ADAMS Accession No. ML19259A065. During this meeting, SNC discussed the prerequisites that the NRC would need from SNC in order to safely reduce the 52.103(g) processing time. The meeting slides submitted by SNC can be found under Accession Number ML19249C726.
As discussed in the meetings, the NRC will prioritize safely reducing the administrative processing time for making the 10 CFR 52.103(g) finding to the minimum time necessary. The minimum time necessary could vary from the best-case stretch goal timeline to up to 17 days, as describe in the office instruction, depending on the degree to which the prerequisites are able
M. Yox to be satisfied by SNC. The NRC staff acknowledge that all prerequisites may not be fully achievable due to the realities of a dynamic construction environment and encourage SNC to keep NRC staff informed of potential challenges in meeting the prerequisites.
