DOCKET NO. 50-334 Attached is a proposed response to the June 1,1983 letter from Duquesne Light regarding a deviation from 10 CFR 50, Appendir. E,Section IV.F scheduling requirements for an annual exercise. The licensee is changing the 1984 annual exercise scheduled for February to June at the request of FEMA. We have reviewed the bases and find they provide sufficient justification for granting the enclosed exemption.

EXEMPTION I
Duquesne Light Company (the licensee) is the holder of Facility Operating License No 'DPR-66 (the license) which authorizes operation of the Deaver Valley Power Station, Unit No.1 (the facility) at steady state reactor power level not in excess of 2652 megawatts thermal.
The facility is a pressurized water reactor located at the licensee's site in Beaver County, Pennsylvania.
II The licensee grelides, among other things, that it is subject to all rules,-regulations and Orders of the Commission.
1 3ection 50.54(q) of 10 CFR Part 50 requires a licensee authorized to operate a nuclear power reactor to follow and maintain in effect emergency plans which meet the st6ndards of 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50.
Section IV.F.1 of Appendix E requires each licensee to conduct en emergency preparedness exercise annually. The last annua 1' exercise at Beaver Valley was held on February 16, 1983.

l By letter dated June 1, 1983, the licensee stated that a schedule was
. developed at a meeting on April 21, 1982, by FEMA Region V and NRC Region III i
for the emergency exercise to be conducted during February 1984 and 1985.
Subsequently, a meeting was conducted on January 20, 1983, by FEMA Region III which resulted in the emergency exercise being scheduled for June of 1984 and L
1985. Additionally, the licensee stated that because of Beaver Valley Power 1

jf Regions, the licensee feels the exercise should be planned in accordance with the request of the FEMA Region III host region.
i The licensee has completed corrective actions on the deficiencies iden-i tified during an emergency preparedness appraisal performed on October 4-16, 1981,.and successfully conducted full scale exercises on February 17, 1982, and February 16, 1983, thus providing assurance regarding the capability of state and local officials to respond to an emergency.
h Based on-the above, we find that the delay in the date of in performing the licensee's annual emergency preparedness exercise will not adversely affect the state of emergency preparedness at the Beaver Valley Power Station.' We t-concluded, therefore, that an exemption should be granted.
