Request.for Briefing Schedule ne Committee to Bridge the Gap (CBG) hereby respectfully requests that the presiding officer in the above-captione6 proceeding. establish a briefing schedule on certain issues associated with TRUMP-S.
Rockwell has to date not notified the Board or parties as to when it intends to commence the TRUMP-S project With special nuclear material (StN),
We have no reason to believe that the Applicant will not await the Board's ruling on its license application.
However, should Rockwe15.. ' attempt i such startup prior to the Board's initial decision, important legal questions woulo exist as to whether such startup is legally permissible or proper. As a precaution, CBG respectfully requests a briefing schedule be' established now on those issues, to be activated if Rockwell does not; intend to await the Board's acticn on the license.

startup of any aspect of TRUMP-S that requires Special Nuclear Materials and submission of Applicant's legal brief identifying the asserted legal authority for start-up prior to the Board's ' initial decision in this caser responses by other parties within 20 days of the Rockwell. filings followed by a ruling by the Board in advance of the proposed date for startup.-
Should Rockwell not intend to try to commence activity before the Board's initial decision on the requested license, - this schedule would 'not be activated.
Should Rockwell-already have plans for near-term TRUMP-S activity involving SNM about which it has not yet notified the Board or parties and which would involve startup sooner than forty-five days from the time of the Board's ruling on this request, or should it even have" started such TRUMP-S activity already. without having provided notification,' CBG respectfully would request that the presiding officer expeditiously convene a hearing or pre-hearing conference in Los Angeles to hear argument thereon and provide a ruling as to whether such predecisional activity is to be permitted.
