This refers to the special safety inspection conducted by Mr. W. G. Rogers of

this office on Ndy 30 through November 1,1989 of activities at Fermi 2

authorized by facility Operating License No. NPF-43 and to the discussion of

our findings with Mr. W. S. Orser at the conclusion of the inspection.

The enclosed copy of our inspection report identifies areas examined during the

inspection. Within these areas, the inspection consisted of a selective

examination of procedures and representative records, observations, and

interviews with personnel.

During the inspection, certain of your activities appeared to be in violation

of NRC requirements, as specified in the enclosed Notice. A written response

is required.

The violations regarding the implementation of your 10 CFR 50.59 safety review

program are a matter of utmost concern to the NRC staff. The design of a

nuclear power plant is extremely complex; the approval of that design by the

NRC staff is granted only after a careful review.

10 CFR 50.59 provides you

with a mechanism to alter that design under specific conditions.

It is

therefore incumbent on you that changes to that design be properly identified

and subjected to a detailed evaluation. The examples contained in the attached

Notice of Violation indicate that these objectives are not being consistently

,

met and that changes have been made to your facility which had the potential to

raise the probability or increase the consequences of an accident.

In your response to the Notice of Violation, we request that you discuss not

only your corrective actions for each of the identified examples, but also

describe specific actions
