Dear Mr. Murley:
In response to Reference-A above, the following information, keyed to' Referenced 10CFR21 Report is furnished:

- 3. ' Hatch Incorporated acknowledges;that it did build the six Instrument Racks in response to NPPD Purchase Order 258510.
- 4. Hatch-Incorporated acknowledges that there had to be l 1 loose and inadequately seated ferrules P 2 the possibility that ferrules might have been missing and, p 3) that ferrules might not have been mounted l sufficiently onto the tubing
- 4) no cross-threaded connections are acknowledged except for the one that was reported on Non-Conformance-Report (SO: 5875) September 30, 1986.
This item was furnished to Hatch, Inc. by NPPD.
This NCR was furnished to NPPD as part of the final documentation package and a copy is attached hereto as enclosure 1.
Please be advised that Nebraska Public Power Division, John Hubl, on September 25, 1986 waived the requirement to perform a' pneumatic test.

' Page 2 Instead it was agreed by telephone that NPPD would perform f a leak test upon arrival at NPPD and correct any leaks at that :
time. Based upon this phone call, Hatch, Inc. did not pneumati- i cally test the Instrument Racks nor wrench tighten the fittings i without. benefit of a subsequent leak test. The-fittings were ;
shipped in a finger tight condition only. See Enclosure 2. l If these Instrument Racks had been installed in a "as
. received condition" contrary to enclosure 2, then Nebraska ;
JPublic Power Division must assume all liability for'any safety hazard related to.the use-of the six (6) Instrument Racks furn-ished by Hatch, Inc. -In addition, since these Racks were-shipped on October 2, 1986 and no deficiencies were reported until November 1, 1989, a period in excess of three years and ;
two years past the one year warranty period, it can only be assumed that NPPD did not honor the agreement to perform the 5
leak test upon receipt of the equipment, therefore no further :
action is deemed appropriate, by Hatch Incorporated. ;

- 6. Hatch Incorporated did not manufacture any Instrument Racks other than the six in question.

Please note-that a Hatch certified test report covering the ,
six Instrument Racks has never been issued. This is because i John Hubl at Nebraska Public Power District assumed this respon- '
- sibility. In addition, since so much time has elapsed since delivery of.the racks and-there is no way for Hatch Incorporated to.know what kind of conditions the racks were stored in, we can- '
not assume liability for any defects after expiration of the warranty.
