Response tc NRC Requests for Clarification, Re: Decommissioning.

Funding Assurance Report and Certification Gentlemen:

This letter responds to four oral requests for clarification which were relayed by Messrs. Nerses, Sci::to, et al, in a telephone call on January 3,L1990. The responses to the four oral requests-are as follows:,

First, the Seabrook Nucleor Deconnaissioning Financing Fund Master .

Trust Agreemert is precently effective and in full force. The appron1 by the Governor's Council was rece!.ved prior-to execution of the Trust Agreement by the State Treasurer. This approval is evidenced by the signature of the Assistant Attorney General en page 51 of.the Trust Agreement.

Second, tne funding schedule approved by the Nuclear Decommissioning.

Financing Committee in their Seventeenth Supplemental Order will be updated as required by the Order to reflect the actual date'of commercial-operation and will become Exhibit B to the Trust Agreement. Exhibit C to the Trust Agreemer.t will be each Participant's percentage share of the Exhibit.B payment schedule.

Exhibit E to the Trust Agreement,-the Monthly Transaction Statement, is to be a sample forn specifying the monthly transaction data which is to be provided by' '

the Trustee. This form will be included in the Trust Agreement upon finalization. Each of these Exhibits will be filed as'partLof the updating referred to below.

Third. NHY commits to notify the Commission annually of any changes in the Trust Agreement and'will promptly notify the Commission.of the issuance of any court decision affectig the-Trust Agreeraent.- . In this.

connection, NHY also confirms that the rianaging Agent referred to in'the Trust Agreement will at all times be the entity authorized to operate Seabrook Station Unit 1 in the operating license.

Fourth.-NHY presently anticipates that commercial operation of Seabrook Station Unit 1 will occur within seventy days after.-issuance of a full-power operating license.
