SUBJECT:

ENFORCEMENT DISCRETION REGARDING WNP-2 TECHNICAL SPECIFICATION SURVEILLANCE REQUIREMENT 4.8.1.1.2.d.2 Gentlemen:

In discussions between the Supply System staff and the NRC staff on January 3, 1990, you requested temporary relief from the subject surveillance requirement regarding emergency diesel generator (EDG) fuel oil accelerated stability

. testing. Although the. surveillance results for EDG-2 and EDG-3 were out of specification, you concluded that EDG-2 and EDG-3 remained fully operable for the following reasons:

L Alternate testing of the fuel oil in accordance with ASTM D2276-78 y

determined the fuel oil to be of acceptable quality.

L All other surveillance requirements for the fuel oil have been met.

All recommended fuel oil limits of the EDG manufacturer have been met.

The manufacturer has not established a recommended limit for surveillance i

requirement 4.8.1.1.2.d.2, which is a test performed per ASTM D2274-70.

ASTM D2274-70 testing results are indicative of long term storage stability, and therefore failure of this-testing does not directly reflect on the current fuel oil condition.

The alternate testing performed under ASTM D2276-78 is more indicative of the present fuel oil condition and indicates its acceptability.

Testing performed on January 3,1990, per ASTM D2276-78 Method A indicated that fuel oil condition was well within acceptable limits.

The above was reiterated in writing by your letter dated January 3,1990.

Based on the above and based on discussions with NRR, enforcement discretion

l to expire at 12:00 p.m., January 4,1990. This enforcement discretion was i

extended on January 4, 1990 to expire at 6:00 p.m., January 5, 1990. All other surveillance requirements and Limiting Conditions for Operation remain o

Our_ understanding is that prior to the expiration of this enforcement discretion, you will submit to NRR a technical specification amendment request addressing the subject surveillance and you will continue your ongoing efforts to determine the cause of the original out of specification testing results.

If our understanding concerning your actions is not correct, you should promptly notify this office.
