Jeff Bingaman, Attorney General of the State of New Mexico, b
moves the Presiding Officer for leave to amend his motion to parti-cipate as an Interested State Agency of the State of New Mexico of September 17, 1981 and as grounds therefore, states:
The Presiding Officer has the discretion to allow this amend-ment.
The policies embodied in the Atomic Energy Act and NEPA favor cooperation with the States and public participation.
The Motion to Participate was a general statement of the Attorney General's position premised on the A.G.'s reading of 10 CFR Section 2.715 as being mandatory.
Joint applicants have disputed this in-terpretation and both Staff and Joint applicants have asked for clarification of the A.G. 's position.

6 Such an amendment will clarify the general statements of the original motion and will aid the Board in reaching its Decision.
j Such an amendment will not prejudice any of the parties and is necessary for a fair and full decision by the Board.
WHEREFORE, the Attorney General moves:
1.
That the Presiding Officer allow the Attorney General to amend his Motion to Participate of September 17, 1981.
2.
That the attached amended motion be eccepted for-filing; and 3.
For such other and further relief as the Presic>ng Officer deems proper.
