Inspection 50-423/81-02

This refers to the routine inspection conducted by Mr. S. Ebneter of this

office on January 26-February 6,1981, at Millstone Nuclear Power Station,

Unit No. 3, Waterford, Connecticut, of activities authorized by NRC License

No. CPPR-113 and to the discussicas of our findings held by Mr. Ebneter with

Mr. S. Toth of your staff at the conclusion of the inspection, and to a subse-

quent telephone discussion between Mr. Ebneter and Mr. L. C. Albee of your

staff on February 13, 1981. This also refers to the meeting held at your

office on February 18, 1981 and attended by Mr. Ebneter, Mr. L. Albee of your

staff and Mr. B. Kiley of Stone and Webster G&W).

Areas examined during this inspection are described in the Office of Inspection

and Enforcement Inspection Report which is enclosed with this letter. Within

these areas, the inspection consiaced of selective examinations of procedures

and representative records, interviews with personnel, and observations by the

inspector.

Based on the results of this inspection, it appears that certain of your

activities were not conducted in full compliance with NRC requirements, as set

forth in the Notice of Violation, enclosed herewith as Appendix A.

These

items of noncomp'iance have been categorized into the levels described in the

Federal Register Notice (45 FR 66754) dated October 7, 1980.

You are required

to respond to this letter and in preparing your response, you should follow

the instructions in Appendix /..

With respect to Appendix A, we note that you have corrected Item D, and therefore

you need not address yourself to this matter in your response.

In addition to the apparent items of noncompliance discussed above and in

Appendix A, " Notice of Violation," findings of this inspection also indicate

that several significant weaknesses exist in your design and construction

prog ram'.

These areas are discussed in Appendix B, Significi.nt Observations.

You are requested to inform this office within thirty (30) days of receipt of

this letter of the results of actions you have taken or plan to take to improve

your design and construction program in the areas of significant weaknesses

identified in Appendix B.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter and the enclosures

will be placed in the NRC's Public Document Room.

If this report contains any

information that you (or your contractor) believe to be proprietary, it is

necessary that you make a written application within 20 days to this office to

withhold such information from public disclosure. Any such application must be

accompanied by an affidavit executed by the owner of the information, which

identifies the document or part sought to be withheld, and which contains a

statement of reasons which addresses with specificity the items which will be

considered by the Commission as listed in subparagraph (b) (4) of Section

2.790.

The information sought to be withheld shall be incorporated as far as

possible ints a separate part of the affidavit.

If we do not hear from you in

this regard within the specified period, the report will be placed in the

Public Document Room.

to discuss them with you.
