Your April 30,1981 letter requested that we reevaluate the Class III fee position taken in our February 20,1981 letter to your Company regarding your November 28, 1980 applicar, ion on " operable" for Unit No.1 of the Arkansas Nuclear One Plant. The Office of Nuclear Reactor Regulation's staff completed their final review of your November 28 application on June 16,1981 (approved as Amendment No. 57 to Liccnse No. DPR-51).
Based on their final fee analysis of this application, they have now determined that a Class II fee of $1,2001s appropriate because the N10-1 proposeo Technical Specifications (TS) did not actually deviate extensively from the model TS or Standard TS. Therefore, the review is considered to have been administrative in nature. On this basis, your Company is due a refund of $1,600. This is because with your August 13, 1980 application for ANO-2, your Company paid a Class III fee of $4,000. That application and the November 28 ANO-1 application only require Class II fees of $1,200 each. We are concurrently authorizing the Office of the Contro?ler to refund
$1,600 to your Company. Refunds are generally processed in about two weeks.
