STIPULATION REGARDING SETTLEMENT OF ISSUES For the purpose of resolving Contentions 2 and 5 asserted in intervenor Environmental Coalition on Nuclear Power's ("ECNP")

" Supplement to Request for Hearing," dated June 23, 1980, but not yet admitted as contentions in this proceeding, the licensee (Metrapolitan Edison Company), ECNP, and the NRC Staff hereby stipulate as follows:

1.

In consideration of the information supplied to it by the Licensee and Staff at the m'eetings held on July 11 and August 18, 1980, as docunented by the diagran attached to the letter of October 14, 1980 to Dr. Johnsrud from Ms. Ridoway (copy attached). ECNP withdraws its proposed Contention 2.

2.

In consideration of the modifications of Proposed Technical Specifications 6.10.1 and 6.10.2 effected by the Anendment of Order dated April 28, 1980 and the licensee's further stipulation that it will turn over to any successor licensee of TMI, Unit 2 the records required to be maintained by Specifications 6.10.1 and 6.10.2 (with respect to Specification 6.10.1 this obligation shall be linited to those records for which the five year retention period has not yet expired), ECNP withdraws its proposed Contention 5.

No amendments to the license for Till, Unit 2 or the Proposed Technical Specifications attached thereto are necessary to effectuate this stipulation.

At the July 11, 1980 meeting of Licensee, the NRC Staff, and the petitioners in the TMI-2 OLA proceeding, one of Licensee's technical representatives diagrammed the THI-2 boration control system for you, in our discussion of your proposed Contention 2.

In light of the diagram, you stated that you were considering withdrawing that contention.

At our August 18 meeting, you stated that you were withdrawing your proposed Contention 2, but requested a copy of the diagram for your records.

A copy is here enclosed.

Please note that the diagram is at the same level of detail as the diagram drawn at our July 11 meeting.
