2301 Market Street Philadelphia, Pennsylvania 19101 Gentlemen:
This refers to the unannounced inspection conducted by P. R. Zurakowski of our Region V office on November 5, 1980 of a shipment of radioactive waste shipped from your facility in Delta, Pennsylvania to the Nuclear Engineering Company, Beatty, Nevada burial site.
The inspection consisted of a review of shipping papers, placarding, marking and labeling requirements, radiation measurements, selective contanination surveys and examination of the p ckages and tractor-trailer by the NRC and the State of Nevada inspertors.
Based on the results of this inspection, it appears that one of your activities was not conducted in full compliance with NRC requirements as set forth in the Notice of Violation enclosed herewith as Appendix A.
You are required to respond to this letter, and in preparing :/our response you should follow the instructions specified in Appendix A.
The violation in Appendix A has been categorized at the severity level described in accordance with the Interim Enforcement Policy as published in the Federal Rt.gister (45 FR 66754)

l The violation for which you have been cited has already been the subject of enforcement action by the State of Nevada.
On November 10, 1980, the State of Nevada suspendect your burial permit.
In view of the circumstances surrounding this matter, we have exercised our discretion under the Interim Enforcement i
Policy (45 FR 66754) October 7,1980, and have chosen to issue at this time i
the enclosed Notice of Violation.
After reviewing your response to this Notice of Violation and your proposed corrective actions, the NRC will deter-mine whether further NRC enforcement action is necessary in order to ensure compliance with NRC regulatory requirements.
