ORDER AUTHORIZING DIS?1ANTLING OF FACILITY AND DISPOSITION OF COMPONENT PARTS By application dated June 5,1980, as revised by letters dcted Febraary 19 and March 27, 1981, North Carolina State University (the licensee) requested authorization to dist.'antle the 10 Kw Research and Training Reactor (the facility), at North Carolina State University, Raleigh, North Carolina,

and to dispose of the componen't parts, in accordance with the plan submitted as part of the application. A " Notice of Proposed Issuance of Orders Author-izing, Dismantling of Facility, Disposition of Component Parts, and Temination of Facility License" was published in the Federal Register on April 3,1981 (46 FR 20338). No request for a hearing or petition for leave to intervene l

was filed following notice of the proposed action.

The Nuclear Regulatory Comission (the Comission) has reviewed the application in accordance with the provisions of the Commission's rules and l

regulations and has found that the dismantling and disposal of component parts in accordance with the licensee's dismantling plan will be in accorcance with the regulations in 10 CFR Chapter I, and will not be inimical to the common defense and security or to the health and safety of the public. The basis for i

i the findings is set forth in the concurrently issued Safety Evaluation by the Office of Nuclear Reactor Regulation.

The Comission has' prepared an environmental impact appraisal for this l

action. Based on that appraisal, the Comission has determined that this I

action will not result in any significant environmental impact and that an g

envhunmental impact statement need not be prepared.

Accordingly, North _ Carolina State University. is hereby authorized to e

dismgntle the facility covered by_Fac.ility License No. R-63, and dispose of the component parts in accordance with their dismantling plan and the Com-mission's rules and regulatio5s,T After completion of the dismantling and decontamination, the submission of a report on the radiation survey to confirm that radiation levels in the facility area meet the values defin :6 :n the dismantling plan and inspection by representatives of the Commission, consideration will be given to whether a further order should be issued teminating Facility License No. R-63.

For further details with res'pect to this action see (1) the application for ' authorization to dismantle facility and dispose ~of component parts dated June 5,1980, as revised by letters dated February 19 and March 27,1981,(2) the Comission's related Safety Evaluation, (3) the Commission's Environmental Impact Appraisal, and (4) the Comission's Negative Declaration dated June 1, 1981 (which is also being published in the Federal Register). All of these items are available for public inspection at the Commission's Public Document Room,1717 H Street, N. W., Washington, D. C.
