Dear Congressman Findley:

This is in response to your letter of April 2,1981 regarding the routes used for shipments of spent nuclear fuel.

The new Department of Transportation (DOT) regulations to which you made reference (Radioactive Materials:

Routing and Driver Training Requirements, 46 FR 5298, January 19, 1981) become effective February 1, 1982.

The NRC is considering the development of conforming amendments to its own regulations.

The DOT regulations would require carriers to operate over the interstate highway system unless there is a State designated alternative route.

The rule would encourage States to select and designate routes, taking into consideration local viewpoints and local conditions such as population, accident rates, traffic density, bridge and tunnel limitations, and bypass routes around cities. We understand DOT is presently preparing guidelines for use by States.

In regard to shipments within your State, we have been advised by the Illinois Department of Nuclear Safety that the recent law neither restricts nor bans transportation of spent fuel through Illinois.

Rather, it embargoes storage in Illinois of spent fuel that has been produced elsewhere and prohibits the transportation of such spent fuel into the State for storage unless the State of origin has a reciprocity agreement with Illinois.

The NRC has approved two routes in the 20th Congressional District, U.S.

Highways 24 and 36. These routes, which terminate at the General Electric facility at Morris, will not be used as long as the out-of-State storage ban is in effect.
