Dear Congressman Fish:

We received your lett:r of March 27, 1981 in which you expressed the concerns of the Westcnester County Executive, Mr. DelBello.

We also received correspondence from Mr. DelBello to which we responded directly in our letter dated March 20, 1981.

We have enclosed a copy for your information.

A meeting was held on April 15, 1981, in Albany, New Yor_k to discuss the necessary measures for resolving the emergency preparedness concerns raised by various New York State and local officials. The meeting parti-cipants included representatives from the various State agencies, those seven counties within 10 miles of a licensed nuclear power plant, the four utilities which have operating licenses, FEMA, and'the NRC.

Even though the new emergency plans cannot be fully implemented at this time, the State agencies and counties indicated that they would be used to the extent feasible for any current emergency.

The State believes that legislation is required to fully resolve the offsite planning problems and that rnolution of the legislative issues involved can be achieved within about four months.

Also, we received a letter from FEMA on April 23, 1981, which enclosed a letter from FEMA to New York State, dated April 6,1981, identifying deficiencies in the New York State and local emergency response plans.

Subsequently, the NRC issued a letter of April 24, 1981 (copy attached), to each power reactor licensee in New York, placing them on notice that if the deficiencies were not corrected within 120 days, the Comission will deter-mine whether the reactor shall be shut down until such deficiencies are reredied or whether other enforcement action is appropriate.
