O Corner & Lada Co., Inc.
Docket No. 99900349/80-01 NOTICE OF VIOLATION As a result of the inspection conducted on September 22-26, 1980, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),
the following violation was identified:
Section 21.21 of 10 CFR 21, paragraph (a) states in part, "Each individual corporation, partnership or other entity subject to the regulations in this part shall adopt appropriate procedures to:
(1) Provide for:
(i) Evalu-ating deviations or (ii) informing the licensee or purchaser of this devia-tion in order that the licensee or purchaser may cause the deviation-to be evaluated unless the deviation has been corrected...."
Section 3 of the Corner & Lada Co., Inc. (C&L) procedure for implementing the requirements of 10 CFR 21 states in part, "Upon notification that a possible defect or noncompliance exists, an evaluation of the problem will be conducted by the Material Review Board."
Contrary to the above, an evaluation was neither performed by the C&L Material Review Board after being notified of a possible deviation in rigid sway struts pertaining to disengagement of clamp end spherical bushings, nor were customers informed so that they may cause the deviation to be evaluated.
This is a Severity Level IV violation (Supplement II).
