O Appendix A Notice of Violation Jersey Central Power and Light Company Docket No. 50-363 Construction Permit No. CPPR-96 Based on the results of an NRC inspection conducted on December 18, 1980, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980),
the following violation was identified:
Section 3.E.1 of Construction Permit CPPR-96 requires, in part; that measures be undertaken to assure good practices to minimize the environmenta, impact resulting from the clearing of land and dredging operations.
Contrary to the above, adequate measures were not taken to minimize the environmental impact resulting from construction activities, in that, as of December 18, 1980:
(1) Material had been eroding into Oyster Creek from unstabilized dredging spoils located north of the fire pond and south of sedimentation basin #3; (2) Material had been eroding into the discharge canal from land cleared for construction of the barge unloading facility east of Rt. 9; and (3) Material had been eroding into Oyster Creek from dredging spoils located along Oystar Creek between the discharge canal and the South Access Road.
This is a Severity Levei V violation (Supplement I).

Company is hereby required to submit to this office within twenty-five days of l
the date of this Notice, a written statement or explanation in reply, including:
l (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the l
date when full compliance will be achieved.
Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended this response shall be submitted under oath of affirmation.
