SUBJECT:
ASLB HEARING ON TMI-1 RESTART ( APPARENT C0fCERNS OF INTERVENOR THREE MILE ISLAND ALERT - TMIA)
In its Memorandum and Order dated March 25, 1930 and subsequent Memorandum dated April 24, 1980, the Atomic Safety and Licensing Board in the subject proceeding expressed its concern regarding the completeness of the record on the issue of management competence of the licensee in the event that TMIA or other parties failed to follow through on IMIA's deposition program.
The Board emphasized this concern in light of the Comissiot.':: Order of March 6, 1930 which charged the Board to carefully consider this issue during the proceeding.
Region I has pursued this matter by reviewing transcripts of the depositions taken during the TMIA deposition program and has conducted inspections and investigations into those matters perceived by 1he Region I reviewer to be of concern to TMIA.
The review was conducted by Region I with inspections and investigations carried out by various units within the Office of Inspection and Enforcement.
Specific inspection and investigation reports (attached' hereto either in full or in part) document the results of these endeavors..
The following describes the format in which these materials are presented in the attachments to this memorandum. - Memorandum from R. K. Christopher, Investigation Specialist to James Allan, Deputy Director (Region I), dated July 11, 1980, subject:
Concerns Raised in the TMIA Depositions.
This memorandum documents the review of the depositions taken by TMIA counsel and the general and additional concerns which were perceived by the reviewer in performing this review of the TMIA deposition program.
The numbered concerns contained in the following attachments reference the concerns identified in this memorandum. - excerpts from NRC Management Inspection Report No. 50-289/80-21 (PAB).
This report documents an inspection performed by the NRC's Performance Appraisal Branch which included reviews pertinent to perceived concerns Nos.1, 2, 3,. 5, and additional concern No. 8.
