Dear Mr. Counsil:

The Commission has issued the enclosed Amendment No. 38 to Facility Operating License No. DPR-61 for the Haddam Neck Plant. The amendment consists of changes to your Technical Specifications in response to your application transmitted by letter dated September 29, 1980.

The amendment revises Appendix B of the Technical Specifications by deleting Section 4.2 which contains the requirements for a Shad Monitoring Program.

The objective of ETS 4.2 is to determine the size and population dynamics of the American Shad spawning run in the Connecticut River. The licensee has supported shad population studies since 1965. The results of studies since 1940 are summarized in " Population Dynamics of the American Shad in the Connecticut River, 1940-1977", by Victor Crecco, of the State of Connecticut and provided in the licensee's submittal of September 29, 1980.

The size of the shad population has varied enormously since 1965 but plant operation has not had any consistent effect on these estimates. No thermal blockage has been shown to exist-which would impede the up or down river migration of shad. Analysis of length and weight distribution, sex ratios and age composition were similarly not shown to be influenced by plant operation.

The State of Connecticut will continue to monitor the shad population particularly in determining the level of commercial and sport fishing that will still provide an adequate spawning stock. Concern at this time is on the efficiency of fishways for transporting spawners over upstream dams and

.on juvenile mortality during downstream migration.

Based on the above, we conclude that the changes to the Technical Specifications are acceptable as proposed.

Mr. W. G. Counsil March 10, 1981 We have evaluated the potential for environmental irrpact of plant operation in accordance with the enclosed amendment. The amendment applies only to reporting requirements for the Shad Monitoring Program. We have determined that the amendment does not authorize a change in effluent types or an increase in power level, and will not result in any environmental impact.

Having made this determination, we have further concluded that the amendment involves an action which is insignificant from the standpoint of environ-mental impact and pursuant to 10 CFR 551.5(d)(4) that an environmental impact statement or negative declaration and environmental impact appraisal need not be prepared in connection with the issuance of this amendment.

Since the amendment only changes the reporting requirements for the sbd monitoring program, it is administrative in nature, and it does not involve significant new safety infomation of a type not considered by a previous Commission safety review of the facility.

It does not involve a significant increase in the probability or consequences of an accident, does not involve a significant decrease in a safety raargin and, therefore, does not involve a significant hazards consideration. We have also concluded that there is reasonable assurance that the health and safety of the public will not be endangered by this action and that the issuance cf this amendment will not be inimical to tb? cor:rnon defense and security or to the health and safety of the public.

A copy of the related Notice of Issuance is also enclosed.
