Your application dated May 4, 1979, requested that the Nuclear Reactor Regulation (0NRR) delete certain Appendix B i

. Teal Specifications (TS) relating to non-radiological aquatic monitoring requirements for Fort Calhoun Unit No.1.

A total of $4,000 (Class III fee) was paid for this application pursuant to 10 CFR 170.22.

The U.S. Nuclear Regulatory Commission has now concluded that applications for the deletion of non-radiological aquatic LCO's and other non-radiological monitoring requirements from TS should be exempt from the fee requirements in cases where licensees have an effective NPDES. On this basis, we have determined that an exemption pursuant to 10 CFR 170.ll(b) from the fee requirements of 10 CFR 170 for your May 4 application is hereby authorized by law and is otherwise in the public interest.

Accordingly, we are concurrently authorizing the Office of the Controller to refund a sum of $4,000 to your company.

Refunds are generally processed within a two-week period.
