O APPENDIX A NOTICE OF VIOLATION Union Carbide Corporation Tuxedo, New York License No. SNM-639 Docket No.70-687 Based on the results of an NRC inspection conducted on July 29 - August 1,1980, it appears that certain of your activities were not conducted in full compliance with NRC regulations. These items are infractions.

10 CFR 70.24(a), Criticality accident requirements, requires that, "Each licensee authorized to possess special nuclear material in a quantity exceeding 700 grams of contained U-235...shall maintain in each area in which such licensed special nuclear material is handled, used, or stored, a monitoring system...which will energize clearly audible alarm signals if accident criticality occurs."

Further, 10 CFR 70.24(a)(3) requires that,

" Emergency procedures for each area in which such licensed special nuclear material is handled, used, or stored shall be maintained to assure that all personnel withdraw to an area of safety upon the sounding of the alarm."

Contrary to the above, on July 29, 1980, you failed to maintain a proper criticality monitoring system in that the audible alarms for all but two of the monitors (nine) are bells and the emergency procedures do not call for evacuation upon the sounding of the bells.

Instead, the emergency procedures call for evacuation on a horn alann which must be manually operated upon the sounding of two bell alarms.

Further, the monitoring system described in the licensee's application does not address the monitoring system needed to cover the special nuclear material handled, used, and stored, in the reactor portion of the facility.

Further, the two redundant monitors (both monitors must be in the alann state to activate an alarm) which do automatically cause the evacuation horn to sound are not redundant in a manner such that failure of a single monitor is always in the alarm state as required by Regulatory Guide 8.12, Criticality Accident Alann Systems.

License Condition 14 states, in part, that "...the licensee shall post all storage and use locations with criticality safety signs which indicate the maximum quantity of special nuclear mterial that is authorized at each location.

Contrary to the above, on July 29, 1980, you failed to post a use location where secondaries are welded to the targets with a criticality safety sign.

License Condition 9 incorporates letters dated April 28, 1969, November 5, 1970, and June 13, 1973, into your license.

In the letters dated April 28, 1969 and June 13, 1973, it is stated that wipe tests are made of floors daily and analyzed for beta, gamma or alpha activity as appropriate.

In the letters dated April 28. 1969 and November 5, 1970, it is stated that smear surveys shall be conducted during work with any unencapsulated U235. Re-movable alpha contaminants from 100 cm2 of floor area in excess of 100 dpm shall require immediate clean-up.

Contrary to the above, according to your records for 1980 wipe tests of floors in the laboratories on the second level area above the cells in which unencapsulated uranium is worked upon are made on a monthly rather than daily basis. Further, the removable alpha contamination shown by these smear surveys of the floors routinely show alpha contamination ranging from 100 to 1200 dpm and inmediate clean-up of the floors was not required.
