Appendix A NOTICE OF VIOLATION Public Service of Indiana Docket No. 50-546 Docket No. 50-547 As a result of the inspection conducted on October 31, November 5-7, and 21, 1980 and in accordance with the Interim Enforcement Policy 45 FR 66754 (October 7, 1980), the following violation was identified:
10 CFR 50, Appendix B, Criterion XVI requires that " Measures shall be established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment, and nonconformances are promptly identified and corrected."
Marble Hill PSAR, Chapter 1, Section 1.7, commits to Regulatory Guide 1.28 (June 7, 1972) and therefore to ANSI N45.2-1971. ANSI N45.2-1971,, Section 17, states that, " Measures shall be established...to assure that conditions adverse to quality...are promptly identified and corrected...".
Contrary to the above, the licensee failed to take adequate corrective action with regard to a previously identified item of noncompliance. The licensee failed to adequately review applicable checklists to ensure that any exceptions to the checklists were documented and approved by appropriate individuals.
These checklists were used in conjunction with Special Process Procedure -7, l
Procedure for Physical Inspection and Verification of Previously Accepted Pur-chased Items, which is part of the Construction and Material Verification Program, Final Report. The previous item of noncompliance was identified in Inspection Report No. 50-546/80-23.
