Dear Members of the Board:

In the Second Prehearing Conference Order of December 2,1980, in this matter it was noted that the Staff intended to issue Safety Evaluation Report sections on quality assurance, quality control and licensee management qualification matters which are issues in the tentatively scheduled hearings in this proceeding, by about February 15, 1981.

Certain of the subsequent dates set out in the Order appear dependent upon the SER on these subjects being issued on that date.

As outlined in the attached memorandum of January 23, 1981, necessary work which premises tSe issuance of those SERs has been delayed because the Applicant and Staff could not agree on a time during December or January to conduct that work which involved a review of Applicant's managerial capabilities. This work is now scheduled to be perfomed on February 17-19, 1981, and it appears these SER sections will not be completed until early April,1981.

This will unfortunately affect the schedule set out in the Board's Order of December 2, 1980. The NRC Staff suggests that the present schedule be kept, to the extent possible. Thus the Staff looks fomard to holding hearings on Applicant's past conduct in the construction of the South Texas facility, and most of Applicant's actions in meeting the Commission's Show Cause Order in May, as planned.

In the Staff's view, hearings on other issues involving l

the Applicant's quality assurance / quality control plans for the operation of the South Texas facility and its management qualifications alone would be l

deferred until late June 1981. Similarly, discovery, identification of witnesses, and the filing of testimony on those latter issues to the extent l

c influenced by the SER would be deferred until after the issuance of the SER.

It is suggested that conference be held among the parties at the beginning of the May hearing to set the dates for those matters, or that these matters be addressed in the prehearing conference tentatively scheduled for the week of March 16,1980.
