Dear Consaissioner Moerland:

Your letter to the Secretary of the Commission, dated June 3, 1975, has been referred to me for reply. Answers to your specific questions are as follows:

1.

Minimum standards for nuclear power plants are generally established by the Nuc3 car Regulatory Commission (NRC) j in Title 10, Code of Federal Regulations. In a particular case, wht3 an application for construction permit or operatint' i

license is found to meet NRC standards, the requested permit or license will be issued establishing the specific standards for that case. In the esse of the Big Rock Point Nuclear Power Facility, the plant is required to be operated in conforr.ance with "IC requirements ac established in the Facility License i

and Technical Specifications. Copica of these and related licensing documents are on file at the follouing location:

The sont recent NRC inspection of the Big Rock Point Facility van conducted on May 27-30 and J'2ne 5-6, 1075. A preliminary review of the findinga from this inspection has not identified any items of nonconpliance with NRC requirements.

It should be noted that copies of KRC inspection reports for Big Rock

Point and related correspondence with the Consumers Power Com-pany are also.*on file at the Charlevoix Public Library.

The NRC's inspection program for operating power reactors requires

inspections to be performed at each reactor a minimum of four

[

times per year. During these inspections the NRC inspectors as-i certain whether the licensee is in compliance with the provisions j

of NRC regulations and the conditions set forth in the License i

that NRC policy calls for the majority of these inspections to be unannounced. The licensee is therefore not advised as to the time or nature of the inspection. If noncocpliance is identified, enforcement action is initiated by the NRC as appropriate for the individual case.

NRC regulations require that Consumers Power Company carry

$44,400,000 of underlying fxcancial protection with the balance i

up to $560,000,000 of liability indentification provided under j

the provisions of the Price-Anderson Act at a cost of $30 per year per megawatt of licensed thernal power. All insurance fees i

are paid by the utility. URC requires Consurers Power Commany i

to furnish proof that the rec,uired financial protection is in j

effect for the bib Rock Point Facility.
