Dear Mr. Ferguson:
By letter Serial ho. 976 received from you on December 22, 1980, Mr. Baum of your company requested that VEPC0 be excluded fiom submitting the State of North Carolina Emergency Plan as part of the Surry Power Station Emer-gency Plan.
The reasons given for your request are that the Surry 50 mile EPZ intrudes only 4 miles into North Carolina and is populated by less than 4,500 resi-dents, most of the area is swamp or managed forest with only one third

devoted to agriculture, wind to this area from Surry occurs 0.5% of the year and radioactive doses in this area are well within the limits of the Protective Action Guides.
We have reviewed your request and have given due consideration to the justifications and discussions you presented in your letter.
Pursuant to 10 CFR 50.33(g), we conclude that you request to exclude the North Carolina Emergency Plan is appropriate and that such exclusion will have no undue effect on the health and safety of the public. We therefore approve your request.
