Docket No. 50-29 YANKEE ATOMIC ELECftIC CCMPANY NOTICE OF HEARING Pursuant to the Atomic Eaergy Act of 1954, as amended, and the regulations in Part 2,10 CFR, "Bules.cf hactice", notice is hereby given that a hearing vill be held. on October 8' 1957, at 10:00 A.M. EDST in Conference Roon "F",

Interstate Comunerce Cautission Building,12th Street and Constitution Avenue, N.W., Washington, D.C., to consider the issuance of a construction pemit to the above-named applicant under Sections 104 b. and 185 of the Atomic Energy Act of 1954, as amended. The application is available for public inspection at the Comission's Public Documents Room,1717 H. Street, N.W., Washington, D.C.

The issues to be considered at the hearing vill be the following:

1.

Whether there is information sufficient to provide reasonable assurance that a utilization facility of the general type proposed in the application can be constructed and operated at the location proposed therein without undue risk to the health and safety of the public; 2.

Whether there is reasonable assurance that technical information omitted from and required to complete the application vill be supplied; 3 Whether the applicant and its contractors are technically qualified to design and constmet the proposed reactor!

4.

Whether, (a) purs ant to Section 50.40(b) of the Cournission's regulations, the applicant is financia'Ly qualified to design and construct the reactor, and (b) pursuant to Section 50.60(c)(2) of the Comission's regulations, the applicant is financially gaalified to receive an allocation of special nuclear material; or (c) if applicant is not so gaalified financially, whether, pursuant to Section 50.12 of the Comission's ngulations, an exemption should be granted for a period of one year fra the financial requirements of Sections 50.40(b) and 50.60 (c)(2).

Pending further order of the presiding officer, parties shall file ten copies of each such paper with the AEC and where service of papers is required on other parties shall serve five copies of each.

- he Atomic Energy Cessaission finds that:

A.

De reactor proposed by Yankee Atomic Electric Company (hereinafter " Yankee")

. vill be a utilization facility as defined in the Comunission's regulations con- -

tained in Title 10, Chapter 1, C.F.R., Part 50, " Licensing of Production and Utilization Facilities".

B.

Yankee proposes to utilize the resetor in the conduct of research and

' development activities leading to the demonstration of the practical value of that type of reactor for industrial and consnercial purposes.

C.

Yankee and its contractors, Westinghouse Electric Corporation and Stone

& Webster Engineering C'rporation, are technically qualified to design o

and construct the proposed reactor.

D. 'itie Cournission is satisfied that it has sufficient information to provide reasonable assurance that a reactor of the general type proposed can be constructed and operated at the proposed location without undue risk to the health and safety of the public; and that additional information required to cossplete the application vill be supplied.

De Cossaission believes that the applicant has identified the suo,jects which should be further investigated and that the plans described for carrying out these investigations vill produce the infonnation which vill be needed prior to approval of final design and operating procedures and conversion of this constzvetion per=it to a license.

In the meantime, the Commission believes that approval should be granted to the applicant to proceed with plant construction in accordance with plans and specifications substitted in his application, recognizing that these vill be subject to change as a result of information to be developed later.

Although the evidence submitted by Yankee to date does not justify a finding with respect to the financial qualifications of Yankee, good cause has been shown why the applicant should be granted an exemption

k for a temporary period from the financial requirements of sections 50.40(b) and 30.60(c)(2). Accordingly the continued effectiveness of this permit will be conditioned upon a further showing in this regard as stated below.

Pursuant to the Atomic Energy Act of 1954, as amended, and Title 10, C.F.R., Chapter 1 part 50, " Licensing of Production and Utilization Facilities," the Commission hereby issues a constructior, permit to Yankee to construct the reactor as a utilization facility. This permit = hall be deemed to contain and be subject to the conditions specified in Sections 50.54 and 30 55 of said regulations; is subject to all applicable provisions of the Atomic Energy Act of 1954, as amended, and rules, regulations and orders of the Atomic Energy Commission now or hereafter in'effect; and is subject to any additional canditions specified or incorporated below:

A.

De earliest date for the completion of the reactor is December 1959.

The latest date fx the completion of the reactor is June 1961. The term " completion date" as used herein means the date on which construc-tion of the reactor is completed except for the introduction of the fuel material.

B.

The site proposed for the location of the reactor is the location in Rowe, Massachusetts, described in the wpplication.

C.

The general type of facility authorized for construction is a pressurized light water-moderated and--cooled reactor to produce 154,000- kilowatts of i

electrical energy, as described in the application.

D.

Unless, within twelve months from the date of this construction permit, Yankee submits sufficient information relating to its financial rescurces to enable the Commission to make a finding that the company has adequate financial resources to meet the requirements of the law and regulations, this perwt shall expire; provided that the Commission may for good cause shown extend the time for the submission 6f such data.

This permit is provisional to the extent that a license authorizing operation of the reactor will not be issued by the Commission unless Yankee has submitted to the

-Ccamission (by proposed amendment to the application) the complete, final Hazards Sum =ary Report (portions of which any be submitted and evaluated from time to time) and the Comnission has found that the final design provides reasonable asstrance that the health and safety of the public will not be endangered by operation of the reactor in acccrdance with the specified procedures.

k Upon completion (as defined in Paragraph A above) of the construction of the facility in accordance with.the terms and conditions of this permit, upon the filing of any addi-tional information needed to bring the original application up to date, and upon a find-ing that the facility authorized has been constructed in conformity with the application as amended, and in conformity with the provisions of the Act and the rules and regulations of the Commission and in the absence of any good cause being shown to the Commission why the granting of a ~1icense would not be in accordance with the Act, the Commission will issue a Class 104 license to Tedee pursuant to Section 104(b) of the Act, which license shall expire forty (40) years after the date of this construction permit.'

Pursuant to Section 50.50'of the regulations in Title lo, Chapter 1, C.F.R., Part 50, the Commission has allocated to Yankee for use in connection with the reactor, 6,052 kilograms of uranium 235 contained in uranium at the isotopic ratios specified in Yankee's application for the license. Estimated schedules of special nuclear material transfers to Yankee and returns to the Commission are contained in Appendix "A" which is attached hereto. Shipments by the Commission to Yankee in accordance with column 2 in Appendix "A" will be conditioned upon Tankee's return to the Commi== ion of material substantially in accordance with column 3 of Appendix "A".
