NOTICE OF VIOLATION Toledo Edison Company Docket No. 50-346-As a result of the _ inspection conducted' between November 7,1989, and January 2,1990, and in accordance with the " General--Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the following violation w g dentified:

Technical Specification Limiting Condition for Operation 3.3.1.1 requires that, as a minimum, the Reactor Protection System instrumentation channels of Table 3.3-1, " Reactor Protection System Instrumentation" shall be operable.

Table 3.3-1 lists the total number of channels for Flux-Delta Flux-Flow as-four, lists its applicable modes as one and two and lists Action 2 as'the applicable Action Statement. Action 2 states that with the number of operable channels one less than the total number of channels power operation may proceed provided that the inoperable channel is placed in the tripped condition within one hour.

Contrary to the above, from about 5:02 a.m. on September.24,1989,-until about -

2:12 p.m. on September 25, 1989, the plant was operated in mode one (power operation) with channel 2 Flux-Delta Flux-Flow instrumentation inoperable without the inoperable channel being-tripped.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, you are required to-submit to 3

this office within thirty days of the date of this. Notice a written statement j

or explanation in reply, including for each violation:

(1) corrective action taken and the results achieved; (2) corrective action to be taken-to: avoid' further violations; and (3) the date when full compliance will be' achieved.

Consideration may be given to extending your response time for good cause shown.
