D. Schaefer and A. McQueen of this office on Occember 11 and 13, 1989.
This letter also refers to the discussion of our preliminary inspection findings j
held by the inspectors with Mr. J. T. Dooley, Vice President, Finance, and yourself on December 13, 1989.
Areas examined during this inspection included activities related to the physical protection of Special Nuclear Material (SNM) as described in the enclosed inspection report.
Within these areas, the inspection consisted of selective examinations of procedures and records, interviews with facility and other personnel, and observations by the inspectors.
Based on the results of the inspection, it appears that certain of your activities were not conducted in full compliance with NRC regulations, as set forth in the Notice of Violation, enclosed as Appendix A to this letter.
The item in Appendix A has been categorized into a severity level as described in the NRC Enforcement Policy, 10 CER Part 2, Appendix C.
Pursuant to the provisions of 10 CFR 2.201, you are required to respond as indicated herein.
In accordance with Section 2.790(d) of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, documentation of the findings of your safeguards measures are exempt from public disclosure; therefore the enclosed inspectionreport,Ap)endixA,andyourresponsetoAppendixAwIllnotbe placed in the Public Jocument Room and will receive limited distribution.
The response' directed by this letter and the accompanying notice is not subjecttotheclearanceprovisionsoftheOfficeofManagementandBudget, otherwise required by the Paperwork Reduction Act of 1980, PL96-511.
