ENFORCEMENT DISCRETION FOR SEQUOYAH NUCLEAR PLANT This letter acknowledges your letter of December 17, 1989, requesting relief from Technical Specification 3.3.2.1 Item 9.a. which requires four operable Refueling Water Storage Tank (RWST) level channels with the units operating in Modes 1, 2, 3 and 4.
In a telephone conversation between Joe Bynum and other members of your staff and B. D. Liaw and the NRC staff at 6:15 a.m. on -
December 16, 1989, you were informed that discretionary enforcement action would be granted for Sequoyah, Units 1 and 2 to allow a 48. hour extension to LCO 3.3.2.1', Jtem 9.a. in order to return the inoperable Unit 1 RWST level transmitters to operable status. This discretionary enforcement was extended to Unit 2 at 11:55 a.m. on December 16, 1989. This extension expires at 3:57 a.m. eastern standard time on December 18, 1989.
The enforcement discretion was granted based on con'.nitments from your staff that: =(1) prompt actions will be taken by TVA to return the RWST level trans.

The staff evaluated your justification for the discretionary enforcement and finds that compensatory measures are adequate and that granting this extension has no significant impact on plant safety and precludes the shutdown of both Sequoyah units during adverse weather conditions.
