APPLICATION OF THE NRC STAFF FOR ISSUANCE OF A SUBPOENA Pursuant to i 161c of the Atomic Energy Act of 1954, as amended, 42U.S.C.$2201(c),and10C.F.R.$2.720(a)oftheCommission's regulations, the Staff of the Nuclear Regulatory Commission (Staff) applies for issuance of the attached subpoena. The subpoena would require the named individual to appear and testify and to produce documents at a deposition in this matter which is scheduled to begin on December 4, 1989.
The individual named in the attached subpoena is Bruno Schiavello, Engineering Manager, Fluid Dynamics, Dresser Pump Division, Dresser l
Industries,Inc.(Dresser). Dresser is the nanufacturer of the pumps at 1
issue in this proceeding. The Staff seeks to depose Mr. Schiavello to l
obtain evidence which may be relevant to this proceeding as more fully I
set forth on the schedule attached to the proposed subpoena. Thus, this request for issuance of a subpoena to require Mr. Schiavello to testify and produce documents is in compliance with 10 C.F.R. $ 2.720(a) of the Commission's regulations. The subpoena is addressed to Mr. Schiavello c/o l
