APPENDIX A NOTICE OF VIOLATION IRT Corporation License No. SNM-1405 P. O. Box 80817 San Diego, California As a result of the inspection conducted on Februar and in accordance with the Interim Enforcement Policy, 45 FR 66754 (y 23-24,1981, October 7,1980), the following violations were identified:

A.

10 CFR 20.207 requires that licensed materials stored in an unrestricted area be secured from unauthorized removal from the place of storage.

Contrary to 10 CFR 20.207, on February 24, 1981, a fifty-five gallon drum of waste materials containing 200 micrograms of plutonium and less than 0.5 grams of uranium-235 was stored outside IRT's controlled areas at the John J. Hopkins Drive facility.

This is a Severity Level V violation (Supplement IV).

B.

License Condition 8 states that authorized materials may be used in accordance with the statements, representations and conditions specified in the licensee's application dated December 8,1971, and as supplemented by letters dated May 14, 1973, January 15, February 5 and March 14, 1974.

The letter dated May 14, 1973 states that criticality monitors will be calibrated semiannually.

Contrary to this requirement, on February 24, 1981, the criticality monitors located at the John J. Hopkins Drive facility had not been calibrated in over a year. One Eberline RM-12A criticality monitor at the John J. Hopkins Drive facility was marked as having been calibrated on 7-18-74.

Section VIII, " Instruction of Personnel" of the December 8,1971 application states that, " Periodic retraining will be conducted as appropriate on an as-needed basis, but spacing will not exceed a period of two years time."

Contrary to this requirement, licensee representatives stated that three individuals who had worked with licensed materials under l

NRC License SNM-1405 during the calendar year 1980 had not received any radiation safety training since May 10, 1978.

10 CFR 70.24(a)(3) requires that emergency drills to familiarize personnel with the evacuation plan must be conducted where quantities of licensed special nuclear material (as designated in 70.24(a)) are authorized to be handled, used or stored.

Contrary to this requirement, no emergency drills have ever been conducted at the John J. Hopkins Drive facility where special nuclear material in excess of the amount designated in 70.24(a) were stored at the time of the inspection.

This is a Severity Level V violation (Supplement VII).

D.

10 CFR 20.407 requires each licensee to submit an annual exposure summary report for the calendar years 1978 and 1979. These reports were required to be submitted within the first quarter of calendar years 1979 and 1980.

Contrary to this requirement, the annual exposure sumary report for calendar year 1979 was filed on February 11, 1981. Since the report has been filed, no further response to this item is required.

This is a Severity Level VI violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, IRT Corporation is hereby required to submit to this office within twenty-five days of the date of this Notice, a written statement or explanation in reply, including:(2)(corrective steps

1) the corrective steps which have been taken and the results achieved; which will be taken to avoid ferther items of noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
