This is in response to your letters dated June li,1980; September 9,1980; September 11, 1980; Decenber 3,1980; December 5,1980; January 21,1981; and Febeu ary 16, 1981 which transmitted page changes to your Fundamental Nuclear Material Control Plan and requested specific exemptions from the requirements of 10 CFR 70.51(e)(3)(1) and 70.57(b)(3).

We have detemined that approving the aforementioned page changes and exemptions will not endanger the cosanon defense and security and that it is otherwise in the public interest t'o, do so. Subsequently, License Condition 2.1 is being revised to acknowledge approval of the page changes and the requested exemptions are being granted by inclusion of new License Conditions 4.9, 4.10, and 5.4.

In addition, since our review of your license amendment indicated that some of your existing license conditions were obsolete, we are deleting License Conditions 3.1, 3.4, 4.8, 4.10, 6.1, 7.1, and 7.2; modifying License Conditions 4.1, 4.2, 4.4, 4.5, 4.6, 5.2, and 5.3; and renumbering the remaining license conditions, as appropriate.

In order to incorporate the above changes into your license, effective insnediately, we are revising sections 1 through 8 of Amendment No. MPP-2 to your License No. SNM-1097 in their entirety, as reflected in the enclosure -

to this letter. These changes were discussed with you on April 30, 1981 and consensual agreement concerning the acceptability and wording of the new license conditions was reached at that time.

We have detensined that the attachments to your letters dated June 11, 1980; September 9,1980; September ll,1980; December 3,1980; December 5,1980; January 21, 1981; and February 16, 1981 contain infonnation of a type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1),

such infonnation is deemed to be comunercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
