LICEN,SEE'S RESPONSE TO STAFF'S MOTION TO CONFORM PROPOSED TECHNICAL SPECIFICATIONS IN ACCORDANCE WITH AMENDMENT OF ORDER By Order of the Director, Office of Nuclear Reactor Regulation, dated February 11, 1980, the Commission established a set of formal license requirements reflecting the post-accident condition of the TMI-2 facility and assuring the continued maintenance of the current safe, stable, long-term cooling condition of the facility.
The February 11 Order further provided that the requirements of the proposed Technical Specifications (attached to the Order) were immediately effective, with an opportunity for hearing prior to the effectiveness of the proposed i
formal license amendment.
At the time the February 11 Order was issued, both the Staff and Licensee anticipated that, during the pendency of this matter, changes in the proposed Technical d

. Specifications might be necessary as the facility status evolves as a result of ongoing recovery efforts.
On November 14, 1980, the Director of the NRC Office of Nuclear Reactor Regulation issued an Amendment of Order, to provide for the use of the Mini Decay Heat Removal System (MDERS) as an acceptable means of cooling the reactor core, in lieu of natural convection circulation.
The Amendment of Order also eliminates the operability requirements for certain Balan"a of Plant (BOP) systems (inposed pursuant to the February 11, 1980 Order), which have been used since the March 28, 1979 accident, but would no longer be required to remove decay heat.
Notice of the November 14 Amendment of Order was published at 45 Federal Register 77205-77207 (November 21, 1980).
By the November 20, 1980 "NRC Staff Notice of Issuance of Amendment of Order and Motion To Conform Proposed Technical Specifications In Accordance Therewith," the Staff has moved that the proposed Technical Specifications attached to the February 11, 1980 Order be formally modified in accordance with the November 14, 1980 Amendment of Order, subject to the authority which 10 C.F.R.
- 2. 717 (b) reserves to the Licensing Board in this proceeding.
As Licensee understands the Staff's motion, it is simply a request by the Staff that the Board issue an order notifying all parties that the proposed Technical Specifications under consideration in the prospective hearing requested in this proceeding are revised in accordance with the November 14, 1980

. Amendment of Order (i.e.,
the document before the Board is revised to replace pages 3.1-1, 3.1-2, 3.4-1, 3.7-1, 3.7-2, 3.8-3 and 3.8-4 attached to the February 11, 1980 Order with the pages 3.1-1, 3.1-2, 3.4-1, 3.7-1, 3.7-2, 3.8-3 and 3.8-4 attached to the November 14, 1980 Amendment of Order), and the Recovery Operations Plan is. revised to replace pages 4.1-1, 4.1-2, 4.7-1 and 4.7-2 attached to the February 11, 1980 Order with the pages 4.1-1, 4.1-2, 4.7-1 and 4.7-2 attached to the November 14, 1980 Amendment of Order.
Reviced " overleaf" pages (which provide the bases for the specifications of Section 3.0, but are not considered a part of the technical specifications, pursuant to 10 C.F.R. 50.36) are also attached to the Staff's motion, pages B 3/4 4-1, B 3/4 7-1 and B 3/4 7-2 attached to the February 11, 1980 Order are replaced with the pages B 3/4 4-1, B 3/4 7-1 and B 3/4 7-2 attached to the November 14, 1980 Amendment of Order.
The formal license amendment incorporating the proposed Technical Specifications, as amended, would await the outcome of the prospective hearing.
With this understanding, Licensee does not oppose the motion.
