This responds to your letter of June 26,1980 wherein you mquested ex-emption fmm the requirements of certain sections of 10 CFR Part 73 for i
your Wood River Junction. Rhode Island facility.
We have considered all of the followings a) The scheduled reduction of inventory of strategic special nuclear material (SSNM) at your Wood River Junction Site; b) the detailed justification and rationale for the requested examp-tion as contained in your above referenced letter and discussed by your representatives with members of the NRC licensing staff over the past thme month's; and c) the adequacy of the protective measures required by your existing physical security plan. as modified by current license conditions.
On the basis of our evaluation of the foregoing, we have determined that the granting of the requested exemption will not endanger life or property or the coscoon defense and security, and is othemise in the public interest.
Accordingly, under the authority of the Commission to grant exemptions to requirements of 10 CFR Part 73, as authorized by law and as provided for in Section 73.5. you are hereby granted exemption from the raquirements of Sections 73.20. 73.45 and 73.46 relating to upgraded physical security re-quirements; to include the specific exemption from the requirement-to sub-mit a revised " Category I" physical security plan. This exemption is ef-factive fassediately.

In the event you are unable to meet that date, this exemption is to be considered withdrawn and you will be re-quimd to submit a physical protection plan as required by 10 CFR 73.20.
This acLion is to assure that if you are unable to reduce your holdings of SSMM below formula quantities before March 20. 1931 you will be prepared to meet the level of protection required by the Upgrade Rule in accordance with the prescribed implementation schedule.
We have determined that your above refcrenced letter and the attachment thereto contain information of a type specified in 10 CFR 2.790(d). Ac-cordingly, they are deemed to be counercial or financial information with-in the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
