Dear Ms. Clauson:

Thank you for your letter of July 9,1979. As you have requested, I have enclosed a. copy of the proposed rule,10 CFR Part 72. Since 10 CFR 72 has not been adopted as a final rule, it dc s not apply to the West Valley facility, which is a shutdown nuclear fuel reprocessing plant. The facility is licensed under the provisions of 10 CFR 50, a' copy of which is enclosed for your infomation.

Because of the interest expressed in your letter, I am enclosing two other documents which are briefly described below:

1.

The Nuclear Regulatory Cominission (flRC) staff's Interim Safety

Evaluation I dated August 1977.

This evaluation describes the staff's assessment of safety considerations associated with the shutdown reprocessing facility.

2.

A letter from the HRC to the co-licensees dated May l4, 1979, foniarding copies of reports from our consultants on the effects of a severe earthquake on the fuel receipt and storage pool at West Valley.

I am including these reports because of your interest in fuel storage.
